Q: Clarification regarding marriage and divorce

Hi, My husband was married to a girl in 2013 according to bengoli rituals and they both were bengoli. After 2-3 days of living together he found her addicted to drugs and smoking and behaving very abnormal way. After 45 days of marriage he decided to step back and finish this matter so he ask that girl to go back to her parents and he will file a divorce against her. She accepted his opinion and both get separated. my husband tries to file a divorce but she refuses come. Finally a lawyer said that you dont have any proof and even that girl is not coming to file a divorce you should go back and start your new life. in 2015 my husband and I met, I am rajput girl and we got married I know the whole story but I dont have any problem we done with Arya smaj wedding and gurudwara wedding and I have certificates of both the wedding but not court certificates. Now after 5 yrs she send me a msg that she file a case against my husband. Plz advice is the previous marriage is null and void ?

What you have written here not completely to understand. If it’s matter for section 138 cheque bounce so it’s understand the technical part, where and when however if you filed the case then you have to go to advocate

Q: Divorce Under Special Marriage act and Muslim Law.

My marriage (4 Years) is registered under special marriage law and my sisters as per Muslim law (5 Months). My sister is married to my wife's brother recently, Now we both siblings want to get separated, but they are threatening to drag my case long and dont want to release me easily, and want to end his marriage ASAP. The problems has been created from their sides and sending us talaqnama by tuesday. Suggest how to end both the cases in best interest of my family.

Not to much worry because sending talaknama is not sufficient for divorce. You have to fight for that. Secondly to understand better this case you need to call me so I can give you advice as per case.

Q: How can women accused of adultery get the custody of her child

my husband wants to get divorce on grounds of adultery. Yes i was talking to my ex lover post my marriage. i had pleaded to forgive me but he is not accepting my plea, he has my phone recordings in which i am talking to him,talking about our failed love and about the hardships we are facing in our marriages. I have met him also but we had no physical connections after marriage. so can he file case against me on grounds of cruelty. Also we have a daughter of 3.5 years.from our marriage can i get my childs custody if he is not able to prove adultery against me. I am working right now and from the past few days living in my parents home but go and visit there home to meet my child after work. can they prevent me from meeting my child. my child is too young and they arev creating an atmosphere that she has started getting detatched frm me. please help.

You can meet your daughter anytime and anywhere. You can also take the custody of her becaus she is 3.5 years old. Also he can file the case but talking with ex lover or meeting is not the ground of adultury.
