What to do if legal notice against cheque bounce has been returned

I had sent a legal notice to the opponent for a cheque bounce for the amount of 5 lakhs but they had returned the legal notice without replying to it 15 days are over what is the next step how do I summon them to the court what is the procedure and how long will it take ? Also the opponent has sent a message threatening that he will file a complaint with IG of Police for sending a legal notice
You can file a compliant before the concerned jurisdictional magistrate and the court would send the summons. The party has to reply for the notice if not paid the amount has to face the trial for further details contact us

Not Accepting or returning of RPAD is also to be construed as received. You may initiate a complaint under 138 NI Act before any fast-track court or Judicial Magistrate. I strongly advice you to engage a lawyer who can explain things to you, even if it is merely as consultation. You need to file the case within 30 days from the date of sending legal notice. Do not give ears to the threats of opposite party like Police. Once the court procedure starts, police has no say in the matter. You may reach out to me if you are unable to find anyone.

the cheque bounce case u/s 138 of nia shall be initiated before the proper criminal court. the threatening of case shall be filed as a counter case to the opposite party. the cheque bounce case shall have to be concluded within one year
