Questions Answered by Advocate Sathya Narayanan Subramanian
Q: 5yrs of separation but no divorce
Hello. I got married in 2019 in Gobichettypalayam and we lived on and off for 10 months with lots of problems. Finally we got separated on the day of Diwali 2020. Now it has been almost 5 years since we got separated and she is not willing to live with me or give me mutual divorce. She tells me that she will give divorce only if he finds someone else or demand that I pay 20 lakhs (which I don't have as I am only earning 25k a month). Is there a way to divorce without paying or paying what I can?
Advocate Sathya Narayanan Subramanian answered
I would highly recommend that you file for an RCR petition that is restitution of conjugal rights, so that she will be obligated to come either live with you or Divorce. This is the best option that is available considering your current scenario.
Q: Second wife file case against our family
My husband married the another girl without divorce. Now he leaves that girl, and joined with our family. Now that girl can complain any case?? If she files any case, will my husband got punished??
Advocate Sathya Narayanan Subramanian answered
The first wave can always file a criminal complaint against the husband for performing second marriage without granting divorce, provided the husband is a Hindu or a Christian. The same provision will not be applicable for Muslim.
Q: HMOP dismissed 2 years ago, shd file new or reopen to fastrack divorce
Married in 2021. Wife hid her physical illness before marriage ,then left my place at 2022. I filed for contested divorce, which later dismissed. Wife making false allegation through DVC and refusing to divorce for the past 3 years. I lost my hope in marriage. Should I reopen the old HMOP or file a fresh one - to get divorce sooner without waiting period.
Advocate Sathya Narayanan Subramanian answered
File fresh petition with new allegations. Since the old petition has already been dismissed, there is no use of reopening the same. However, when you file a new petition with a new cause of action such as filing of domestic violence case and causing mental stress is also a ground for divorce.
Q: To whom the property will be owned
The grandfather had 2 sons. For his 2 sons, each ha one child. The grand father in his will document, he stated that his property is not for his sons but for his 2 grand sons. But now one of his grandson died due to covid. To whom the assets will be owned
Advocate Sathya Narayanan Subramanian answered
Heirs of grandson. As the condition of the will cannot be fulfilled, the next best option would be the heirs of the grandson. In this case, the mother and father of the grandson. If they are alive. Or, if the said grandson is a major and married, then his wife and children.
Q: What happens if the court loses your file
My case file is missing from court during case sent to master court from bench court. It is not traceable since a year. What is the next step for me . I am stuck
Advocate Sathya Narayanan Subramanian answered
File a Crl.O.P in High Court for reconstruction of bundle. a new card bundle will be constituted with available Xerox copies, or in case there are no copies available, afresh trial may be ordered. in the case of civil, Office copies of documents may be used to reconstruct the bundle with the permission of the superior court. (District Judge in the case of Sub Court.)., as the case may be. internally the matter will be reported to High Court and a memo will be issued to the concerned staff in who's possession the bundle was supposed to be.
