What to do if a cheque is dishonoured

I gave 148000 to a person for purchasing a plot from him .Total cost of the plot is 240000.He give me a reciept as a reality firm .But i think he has no regd for the firm. Later he didnot sell the plot to me as he has no town planning permit.So he give me a cheque dated 30 4 2018.if the cheque is bounced then cheque bounce or civil case can be done?

If a cheque is dishonored,a notice u/s.138(b) is to served on the person who has issued the cheque for payment of the amount within 15 days of receipt of the notice .If not paid then a case is to be filled.

Cheque bounce case is advisable. Make sure to follow the procedure within the time limit . ..
The cheque has a validity of 3 months. You can present the cheque to bank for clearing process with the stipulated time as mentioned above. If cheques gets Dishonored, we can claim the amount mentioned in the cheque with the substantial proof of payment made to the developer. We can file a criminal case against him.

In your case if the the cheque is dishonour for insufficient balance then he will be prosecuted under section 138 of NI Act. And also if he is intentionally did not return your money and cheated you then you can file a suit against him for realisation your money and also complain before police against him how he cheated you.

U deposit the cheques in your account.If cheque bounced, then sent cheque amount demand notice within 30 days from the date of return of cheque u/s 138 N.I.Act.u should sent 2 demand notice.one to company and second to person signing the cheques.Consult cheque bounce lawyer
