You can send the legal notice 15 days prior to the filing of the case . If he makes the payment in due time then you can refrain from filing the case u/S 138 of the NI ACt so first send them a notice with the proper consideration mentioning as when and how the cheque has been given to you and under what consideration.

In this situation you need to consult as this is not just a case of cheque bounce but a fraud. For consultation you should carry the details of;
1. The reason of issuance of the said cheque
2. Detail of the cheque holder
3. Detail of the transaction to which the cheque holder had to pay
4. bouncing of cheque details from the bank

hello,
since you were signatory of the said cheque you are liable under Negotiable Instrument act and now you will have to be part of the proceeding . however if you havent signed the cheque in question you can prove that you had no liability and you were merely a joint signatory.

Hello,

Can issue a notice to the person who has Bounce the check giving him 15 days of time to return the money back.

Although if it doesn't return the money we can file a case in the court for the recovery of the amount.
