What action can be taken in a cheque bounce case

I have a check which is given on the behalf of security of my money.but after so many days he is not willing to return my money.so pls help me by filing the check bouncing case

Has the cheque bounced?
If not, then please present the cheque at the bank. If it bounces, then feel free to contact a local lawyer and thereafter proceed to sending him a notice for dishonour of cheque.

we will need a copy of the cheque as well as of the return memo. the case will be filed in the court having jurisdiction of the branch of your bank and before that we need to send a notice as per the statutory requirement

Sure don’t worry about your money. You will certainly get your money back. We can file a case under section 138 of the negotiable instruments act. Don’t delay this as if you delay it can be a problem .

As you have mentioned that you have a cheque which has been given by the other party as a security of your money. For filling the cheque bounce case first you need to submit that cheque in your account, get it bounce once then there is a formal procedure of notices. First of all see the date on cheque whether it was mention over there or not, if the date was mention kindly deposit it in your account for bounce in within three months from the date mention on the cheque. If the date was not mention than put the date of current month on the cheque for bounce.

After the bouncing of the cheque you will able to send legal notice under section 138 of cheque bouncing act within 15 days minimum or 1 month maximum to the party and also able to file case under this act.
