Sold a car buyer gave a cheque which got bounced want to file a case

I sold a car on affidavit to Mr M. He gave me cheque and the cheque number is also mentioned in affidavit. Cheque got dishonored due to insufficient fund and Mr M sold car to someone and not paying me. When i enquired i get to know that Mr M has many such cases and is fraud. Is there any solution for this issue?

Yes you can file case under section 138 of NI Act upto date against the person issued cheque to you and also can file police complaint in the matter without any further delay as it is time bounded matter, as their is life of cheque i.e. 90 days.

Yes you can file a case against Mr M u/s 138 of Negotiable instrument act nd also file a criminal case u/s 420 IPC. As he is a habitual offender you will definitely have a good case against him. For any further information please contact

U can file the case but what about the RC , have u transferred the RC also.
Does not matter , whether he has any other case. U can get u r money back.
U contact a lawyer he will file a case for Sec 138 NI and also fraud of selling it to some one else without payment to u.
