Recovery of unaccounted money lent to a person

I gave a loan to a person for Rs 25 lakhs in cash and took a cheque from him for the same amount as a security. The cheque is not dated. Can I recover my money by bouncing the cheque? The cash that I gave as a loan was not accounted for in my books.

Sir, as you have depicted in your query that you have a cheque as security, its a positive tool for recovery of your amount but in addition to the same you have frame some more**. Your amount is still safe and can be easily recovered contact for the fast action as per your discretion.

Yes definitely you can fill the amount and date and submit it to the bank. If the cheque bounces than you can file case against him under section 138 of negotiate instrument act. Your money will be recovered through court.

In case you have provision in your accounts in last FY or in recent past for showing the amount as loan ,you can do the same and thereafter present the cheque in the bank and on its return can follow the procedure of sending notice for payment and on failure to get response /money file the complaint under N.I.Act and followup the case against the person who gave cheque.

Yes you can fill the cheque for the same amount and get the cheque bounced. Cheque given as security is covered under negotibale instrument act. The fact that you have not shown the said amount in your books will not effect your legal remedy.
