What are the legal implications for the cheque bounce
okay I understood your question first you have to bounce the cheque and send legal notice to accused person and take acknowledgement ans he is replay or not replay wait and next you have to fileva check bounce case means negociable instrument act under you have to file case at magistrate court thank you
Dear Sir,
You have to present the cheque for encashment within its validity period. If it is undated then put your convenient date. Take dishonor Endorsement from the Bank. Get issue a legal notice within 30 days. Then within 45 days you can file cheque bounce case under Section 138 of Negotiable Instrument Act. You can get judgment in your favour within 6-12 months.
When the cheque bounces due to insufficient funds and is returned by the bank, the payee should send a legal notice to the drawer of the cheque asking to make the payment. The legal notice acts as an intimation to the drawer of the cheque that the amount mentioned in the cheque needs to be paid by him. If he does not comply with the legal notice, then legal action can be taken against him. The legal proceedings can be initiated in the court within thirty days from the expiry of fifteen days time period for cheque amount payment after receipt of cheque bounce notice by the drawer. The case will be filed under Section 138 of Negotiable Instrument Act. If you need any assistance in filing a case you can contact us.
