Legal remedies in cheque bounce due to sign mismatch

My friend gave me a cheque for Rs60000 before one year but he gave his sister's cheque with his sign and I deposited the cheque into my bank it will be return bcoz of sign mismatch and almost one year gone now what I have to do
In regard to the negotiable instrument act 1881 deals with offence of dishonour of cheque .... whether it is joint Account in your case , Have you got cheque return memo by drawer bank . Holder or payee can resubmit the cheque within three months of the date in it

A cheque has got validity of 3 months as per provisions of Negotiable Instruments Act you should have presented the cheque within the time limit from the issued date if not it has got no value and initiating proceedings now is not viable instead you could file a cheating case against him for more help contact us

The person has not mentioned the date of present of cheque. If it's before one month then a notice shall be issued and the case shall be filed under relevant provisions of NIA. The delay condominium have to be filed.
