Lease Amount cheque by owner dishonored how to recover money

Query: Hi Sir/Madam, I need to know whether the cheque dishonored due to mismatch of signature will be treated as cheque bounce or not. My owner had to pay me 4.5 Lac of which he had paid 3.2 Lac only , and he had issued cheque of 60K and rest he promised to pay within week of vacating the house, however cheque got dishonored due to mismatch of signature(earlier also 1L cheque was bounced but later cleared).I have Memo with me...despite my repeated requests he is not bothered to ans my calls. Can you please advise what is the best way to recover my money 1.3 Lac in total (minus painting charges). also can I give police complaint based on Lease agreement which was expired 1 year back, despite my requests my owner did not vacated me on time earlier ,also did not renewed the agreement either. Please suggest whats the best way to recover my money. Thanks in advance

If the cheque issued to you is not signed by the account holder, it does come under the purview of Section 138 of Negotiable Instruments Act for filing cheque bounce case. However, you may file a police complaint for cheating under Section 420 of IPC.
