Is 2008 cheque is valid

Sir my father had a road accident in 2008 which gave him brain damage . He don't talk . Now the problem. A person clames that he had a blank cheque without date and I think it must be older than 10 years . And mother says that we paid that man. After my fathers accident . Now that man is blackmail me that he file a case

Instantly file a police complaint about that Cheque to the nearest police station. He can’t do anything with that cheque. If it was blank and now he fills the same after your complaint it would be tracked in FSL. So don’t worry about the same. Contact if he does any such act against you or your family. He will have to pay.

Dear Sir, In fact the cheque of year 2008 is not valid now. He should not blackmail you and if you are being done so, you must collect the evidence and then file a complaint in the nearest police station. If no action is taken within 5 to 6 days, you should file the complaint in the area DCP office. You should enclose a copy of the complaint filed with the police station of your area with this complaint. If the person do not get away, you may seek assistance of a lawyer and file criminal case against the person in nearest District court. Do not compromise with him till he pays the amount of expenses incurred and fee spent to ward him off.
In fact if you do not settle, he may be awarded simple imprisonment for his blackmailing act.
It is enough if you mother is ready to say in the court that the amount had been paid earlier and now he is only exploiting the widow.

Is that cheque valid and all what is the name in the cheque and the amount when was the cheque given to
Him do u have any proof that he got The money or he does have any proof or so it will also matter where u can see the cheque dated on what purposes was it be given is he trying to falsely implicate a case on u and your family

If the person who has blank chequw signed by your father hasnt filed any case against you in court, immediately file a ploilce complaint about the lost cheque with all the details of the cheque and further write an application to the bank for stop payment of that cheque along witht the copy of the complaint give in police station. This will help you from penal consequences in case he initiates criminal proceedings against you under section 138 of Negotiable Instrument Act.
