आपने अपने मित्र को कब-कब और किस तिथी को धनराशी किस माध्यम से उधार दी थी, और उन्होंने आपको कब चेक कब दिया था ? साथ ही आप के पास यदि धनराशी उधार दिए जाने के दस्तावेजी प्रमाण है और चेक अभी 3 माह से ज्यादा पुराना नहीं हुआ है तो आप अपने दोस्त के खिलाफ धारा 138 एनआई एक्ट के तहत परिवाद दाखिल कर सकते हैं कोर्ट में सही साबित होने पर उसे सजा भी मिलेगी और चेक में भरी हुई धनराशी या उससे भी अधिक की धनराशी आपको अदा करनी पड़ेगी l पुलिस चेक अनादरण के मामले में प्राथमिकी दर्ज नहीं करती है l

In cheque bounce case some things is nessery as like which date made by cheque and second thing which date cheque bounced then you mai now gave him a notice then you mai now fill the petition judriction court

If notice has already been served and there is no reply from your frn side, you should not delay in filing the case in the competent jurisdiction court as you only have one month time after the date of serving the notice.

Once cheque is bounced you must sent a demand notice of said amount through advocate asking him to pay such amount with 15 days of receiving notice.after laps of 15 days..You must file a complaint under section 138 of n.i act ..When court take cognizance of case,summon and warrant of arrest will be issued by court against him
