Q: Can a case compromised in high court be brought back ,can compromise decree be challenged ?

There are two parties in my village. They had a clash over their children around 3 months ago. After 3 months of clash they made compromise in High court. Now after 3 months of compromise one party is blackmailing other party by saying that they will bring that case back. And by saying this they are demanding money from other party. My question is that if any case is compromised between parties in High court in presence of High court justice, can this compromise can be take back by any party? Or simply one party is blackmailing the other party? what is the latest supreme court judgment on compromise decree Please Answer.

अगर दोनों पक्षकारो के बीच एक बार उच्च न्यायालय के समक्ष समझोता हो गया है और लोवर कोर्ट की प्रोसेडिंग खत्म कर दी गयी है तो फिर दुबारा से कोई भी केस रिओपन नहीं हो सकता है, लेकिन कुछ विशेष परिस्थियों में केस रिओपन भी हो सकता है l रिओपन होना या ना होना यह निर्भर करता है कि पक्षकारो के बीच पूर्व में हुए समझोते की पीटीशन में लिखा क्या गया था क्यों वो समझोता किसी शर्त के अधीन था या बिना शर्त था l अगर समझोता शर्त के अधीन था और शर्त पुरी नहीं की जा रही है तो केस रिओपन हो सकता है l

Case was: Her nephew took to to bank and opened a account in a bank, near to his home. then he requested to her, he needs cheque for security. she did it on good faith and goodwill she sign 04 blank cheques. all the cheques given to him, was used by someone whom she don't know. now they are asking to pay huge some of amount as she is a guarantor. Case was filed under NI Act 138. she is old and heart patient. Is at the time of appearance in court, she needs surety? as she is living on her old age pension, which is 1K per month. or her daughter, who is living in other state can give her surety on vehicle registered in other state? please send reply asap possible.

आपने अपनी समस्या के सम्बंध में पूरे तथ्य नही लिमहे हैं । इस मामले में केस फाइल किये जाने से पहले किसी एडवोकेट का का नोटिस आया होगा । आपके द्वारा उसका क्या जवाब दिया गया, दिया गया या नही । केस में सम्मन कब मिले । सम्मन मिलने पर आपने क्या किया ? चेक किस बैंक ब्रांच के थे कहाँ लगाए गए । कृपया पूरा विवरण लिखकर भेजे तभी इस मामले में आपकी मदद की जा सकती है ।

Q: Family abused - they beat me , tourcher me emotionally physically

My parents used to beaten me , they always forced me , when I did 12 I wanna go to du for higher education but they don't let me there instead of they brutally forced to take admission in my local college , and told me to prepare for neet , it's all self study , since 2 drop I am not able to get mbbs , they beat me , call me slut , and told me that we should kill you in foetus , and I m just 18 I did my 12 and they forced me to leave them , where would I go ? I won't get a job , what should I do ?

आपको समझना होगा कि परिवार में समस्या कहाँ पर और किन बातों को लेकर है । आपके माता पिता आपसे किन बातों की उम्मीद करते है और वो आप कर पाने में सफल क्यों नही हो पा रही है और उनकी नाराजगी का कारण क्या है । इन सब बातों पर आपको गौर करना होगा और उसी अनुसार व्यवहार करना होगा । आपके लिखे अनुसार आपके साथ जो व्यवहार हो रहा है उसे रोकने का विधिक उपाय भी है लेकिन उसका रास्ता कठिन है क़ानून से आपको राहत मिल जाएगी लेकिन रिश्तों के बीच एक दरार भी आएगी जिसे शायद ही कभी भरा जा सके ।

Q: CHECK BOUNCE case Section 138 NI

On 29th April 2019 I had submitted 4 checks amounting 7 lakhs in total. The cheque return memo said INSUFFICIENT FUNDS. The person was trying to cheat me so I consulted a lawyer and send him a notice to repay my money. With the response from his lawyer to grant him 6 months. Which is not possible. Now my lawyer advised me to put a case in criminal and told that he doesn’t advise me to put case in civil as the court will charge me court fees firstly. I am confused that as perSection 138 NI should the case be Criminal or Civil??? As my current lawyer advised me Right??

आपको इस मामले में धारा 138 के तहत ही परिवाद दायर करना चाहिए । क्योंकि धारा 138 में सिविल क्रिमिनल दोनों ही रेमेडी मौजूद होतेर है । उसमें अभियुक्त को सजा होने के साथ साथ चेक की रकम के साथ वाद व्यव भी देने के आदेश कोर्ट करती है साथ ही किसी भी समय समझौते के चांस भी रहत्ते हैं ।आपके अधिवक्ता आपको सिविल सूट लाने की गलत सलाह दे रहें हैं ।

Q: Filming my video and forwarding it on WhatsApp

My brother in law filmed my video without my permission and my mother in law sent it to someone without my permission, that someone has forwarded it to everyone without my permission. Can I take action against anyone???
