Q: cheque bounce case against old widow lady

Old lady aged about 70 years. case filed against her with someone, whom she don't know under NI 138. Case was: Her nephew took to to bank and opened a account in a bank, near to his home. then he requested to her, he needs cheque for security. she did it on good faith and goodwill she sign 04 blank cheques. all the cheques given to him, was used by someone whom she don't know. now they are asking to pay huge some of amount as she is a guarantor.Case was filed under NI Act 138. she is old and heart patient. Is at the time of appearance in court, she needs surety? as she is living on her old age pension, which is 1K per month. or her daughter, who is living in other state can give her surety on vehicle registered in other state? please send reply asap possible.

Hello lo Mera cheque bounce ho gaya tha FIR main mukadma Kiya vakil Sahab ko check de Diya mukadma Ho Gaya uske baad do teen aur stay order Gaye uske baad jiska cheque tha usne Mera paise ka bhugtan kar Diya Bank ke jariye ab vo kese khatam hone ka order bhi de diya jaye samne lekin vakil sahab ka rahe Hain ki woh check Jo wapis milna hai wah judge Sahab ke order karne ki tarike ek mahine baad milega wapas tu aisa kya aisa hi hota hai ki check order ke ek mahine baad milta hai please hamein chala dijiye advice dijiye ki Aisa hi hota hai kya

जिस चेक के संबंध में मुकदमा दर्ज हुआ है उस मुकदमे का यदि निस्तारण हो गया है तो उस चेक की मान्यता खत्म मानी जाती है वह चेक अब कोर्ट की संपत्ति है कोई भी ब्यक्ति अब उसे वापस नही मांग सकता है एयर न ही उसकी अब कोई जरूरत है,ये समझ नही आ रहा है कि जब आपके केस खत्म हो गया है तो आप वह चेक वापस क्यो मांग रहे है।

Q: Criminal Revision In High Court when Application Of 156(3) Is Rejected

Dear sir .. my query is that if an application under 156(3) is rejected by the cjm court in the first instance and then the criminal revision being put under the sessions court and the sessions court also rejects it then can the petitioner approach the high court for further revision ..thanks

yes offcourse you can file revision before high court.revision can be file against any interlocutory order of a lower court.156.3 crpc is also the same order,it is duty of court to here the same.it is the matter of merit whether the petition accept or reject.

चेक बाउंस के प्रकरण में अभियुक्त (चेक देने वाला) अपने बचाव में यह पक्ष रख सकता है कि अभियोगी (चेक लेने वाले) ने उसे जो पैसा या लोन दिया था, उसका सोर्स क्या था?

नही,चेक बाउंस के केस में प्रथम दृष्टया ब्यवसायिक संबंध और चेक दाता के हस्ताक्षर देखे जाते है।चेक निर्धारित अवधि के अंतर्गत अनादरित हो,निर्धारित अवधि में अधिवक्ता के माध्यम से मांग नोटिस भेजा गया हो तथा निर्धारित अवधि के भीतर परिवाद दाखिल होना चाहिए।

Q: Mental harassment and provocation by wife

HINDU i am second time ( first legal divorce in 2011) married for last 6 years in 2012 my wife is harrassing and abusing me. i was in corporates and left job in june 2016 and staying in her owned house for past two years. i am presently looking for a self employed job, she is always abusing and trying to provoke me without any reasons and looking for opportunities so that i might get provoked and do her harm and she can then report the matter to police or a lawyer. she says she does not want to stay with me, but at the same time when I say her for mutual divorce she does not answer anything. I have now concluded that she is knowingly harassing me. and always looking for an opportunity to belittle or demean me when we are alone but in social is does not do this. at times rarely she is fine with her behaviour. I am at a loss at her behaviour. she is self employed and B A M S doctor and doing well. I do not have any bad intentions towards her property or money. i am medically fit at 54 yrs

You did not mentioned here about your child,there must be emotional relation with couple also..There must be love ,affection and division between the couple ..Try to understand her problem and solve amicable..
