How long do i have to wait after sending cheque bounce notice

Refund money from Unitech 5 years after they failed to start a project in form of 7 post dated cheques .3 were honoured .Cheque no 4 and 5 bounced .We sent a notice 7 days have passed no ans .What to do.

You can file a case after fifteen days of sending notice and there is a limitation to file the case within 30days. Please take care of that.

If the Cheque is bounced , you are required to send the notice within 15 days. If even after receiving the notice , Unitech did not make payment, You can file cheque bouncing case under section 138 against Unitech. Please discuss with us for details.

After issuance of notice you have to wait for 15 days to receive the payment.
If no payment has still been received in 15 days, than you 30 more days within which you have to file a complaint before a magistrate.

Within 30 days of dishonour of Cheque we are required to issue legal notice. And from the date of receipt of legal notice, drawer has to pay within 15 days and if he fails to repay within 15 days then you can file case under section 138 NI Act which is called Cheque Bounce case in common within 30 days therefrom.
The reply to the notice should be given within 15 days from service of the notice. If the reply is not received or the payment is rejected within 15 days then you can file the cheque bounce case under section 138 within 30 days after completion of the 15 days.
