Father gave two blank cheques other party bounced it for higher amount

My father gave a two blank cheque to a person and borrowed 1.50 lakhs. After my father death they filled 1st blank cheque for 10 lakhs and made it to bounce. Imediately after 1 month they bounced another cheque for the amount 15 lakhs. We saw advocate and he said we can do ink verifcation and merit will be in our side. But today judge said Forensic report for ink verification is not accepted. Please advice on any other option. Eager waiting for your valuable reply. Thanks

a criminal case can be filed against the person before the high court and a direction as to forensic report may be accepted by the judge may be obtained. the judge has to made a reference to the high court of madras

What was the mode of payment for 1.5L? Was it by cash? If it was paid by account, that alone proves that the value is exorbitant and the case fails for the claimant. If it was given by cash, then the whole case fails as 15L, has to be proven. There is no option for ink verification, your advocate just bluffed. The fact is that only signature can be compared using contemporary document. Contest the case on merit basis and win it. Even if he proves that your father owes 1.5L, he cannot win this case as there is no legally enforceable debt. Get in touch with me personally if you need anything. Google it.

You can send for handwriting expert so that your father’s handwriting and the handwriting in the cheque can be compared. Difference of ink or handwriting both can be identified. Try the comparison of handwriting by court or through expert.

With regard to ink verification as on date only ISRO is doing tests regarding age of the substance which is a costly process used in space matters.

Hence verifying the age of the ink is not possible in India. This is for your kind information. There are other strategy for defending your case.
