Customer gave cheque which got bounced due to wrong signature

Gud evening, i want some information related to cheque dishonored. A customer gave me a cheque on 20 August 2018 and it get dishonored on 24 August 2018. The Bank employee told me that the reason of cheque dishonored is that the signature is not matched. And i have proof like WhatsApp chat, his Adhar card with his signature and passport size photo. Now i want my money. So, what would i do??

Respected sir/ ma'am,
In such a situation you can call upon the concerned customer whose cheque is bounced due to mismatch of specimen signature to ensure that he arranges opportunity to make the payment again.

Hi,

You can ask him to replace the cheque with a new cheque.
If he doesn’t issue other cheque or again Sign on the present cheque you must send a legal notice within 30 days from date of dishonour of cheque .

First of all you have to give notice to the Drawer of the cheque demanding to pay you immediately because his cheque has bounced, within 15 days. If you pays you immediately the matter gets solved. Otherwise you need to get in contact with an Advocate and file a criminal case against him to recover the amount. If you do so, you will win and will get the money.

In cheque bounce case due to whatever reason if the drawer is not paying the money for the amounto fthe cheque bounced, legally you are required to issue notice within period of 15 days from the receipt of the memo and thereafter, after 15 days if there is no response to notice you will be required to appraoch court by filling criminal complaint. Immediately send one legal notice to him demanding the money. Wait for reply for the stipulated time. If reply of legal notice is not given or money is not paid thereafter then file case before appropriate forum.
