Cheque Bounce Summons

Hi Sir just I had filed a petition against a cheque bounce for an amount of 5 lakhs against the accused and also summon has gone from the court and the hearing has been put on 1st of November just want to know is it better if we can claim a demand draft instead of cheque from the accused and also how does the summons go to them from court

it is the court process and it cannot be disclosed on website. on the first hearing itself the court may not order for its execution, be patient till completion of case. it has to be under crpc many procedure has to be made by the court

he's appeared with lawyer.... and that same date ur lawyer asking that amount means magistrates short date given to that accused....

on the date of hearing make sure you present yourself before the court. I would highly recommend you get in touch with the lawyer who can let you know the formalities of surety to be produced either on the very same day or on the next hearing. but do not take your chances by not attending the case. new law states that you will have to pay a deposit of 20%, even to contest the case. contact a lawyer of your choice and after verifying the date of filing the case the lawyer will let you know whether the deposit scheme will be applicable to you or not.

it is highly unlikely that any accused would come forward to settle the amount in the first instance itself. do not have any such high hopes. if you have filed the case after the recent amendment in Negotiable Instrument Act, then you have the option where the accused will have to pay a deposit of 20% of the said 500000 rupees while presenting himself to get Court bail after producing surety. if he doesn't present himself after receiving the summon press for bailable warrant.
