Cheque Bounce NI Act vs 420 which is wise option.

Accused cheated me of 50 lakh, 41.5 lk online and 8.5 cash. he took friendly loan through friendly loan agreement and issued a cheque which got bounced due to insufficient fund.I got to know he cheated various others through ponzi scheme as well to the tune of multiple cr's but mostly have paid cash to him and reluctant to go to police.will my case be considered for 420 as well, as police mentioned it to be civil dispute, but i think its 420,406 when other complaints of ponzi scheme's gets clubbed with mine. Is it worthy to go with 420 along with NI act? if accused may abscond then it would be hard to find him in both the case of 420 or NI act. i doubt he has any asset. Imprisonment is confirmed in both case and should I avoid two simultaneous litigation ?

you should definitely go for both FIR for cheating etc and a cheque bounce case.
making out a cheating case will depend on the facts and information available with us. it's is difficult to convince police to register FIR . but definitely one should make a complaint for cheating. if they don't register FIR then we can proceed to court to order registration of FIR is there is merit in the case. for detailed further information please feel free to contact.

Hi,
After perusing the contents of your query, we would advise you to go for a complaint case under section 138 of the Negotiable Instruments Act. Further complaint under 420 can be made with police authorities and if they dont register an FIR you have an option to file a petition under section 156 (3) of the crpc seeking directions to police to register an FIR.

hello client as i have read ur issue yes it is a big fraud played upon you on the name of friendly loan . it is not only a case of four twenty as well as it is also a case of criminal. breach of trust . along with other section of IPC , along with things of disaaprcinate assets as well in this matter your money will get recoveres but for tht you need to take steps in two way directions one is along with Reat of the people whi got cheated as well as single action is also requires . i can assure you tht you will get you money back tht is also with interest ofpercent as pee court guidelines.
