Q: The property has a illegal possession and the concerned police not reg

A family member illegally took property key from us and created fake property papers in his name with the act of forgery in signature. Further he sold to other person and again it is sold to third person. In regard to this I have compained in police station but they are not filling FIR or not even investigating fairly.

where is the property located ?name of police station ? an application to local court needs to be filed for registration of FIR. the said application is filed before the magistrate having jurisdiction. you may call me for further assistance.



Q: FIR not Showing online even after 6 months

I received 41a crpc notice from police station IO to join the investigation. As per notice FIR logged in Nov 2020 (ipc 420,468 and 471. I asked many times to IO to gv me FIR copy for Bail .. but he is making excuses. Why FIR is not showing online even after 6 months?

because charge sheet has not yet been filed. also for doesn't always show online. you should wrote a letter to sho requesting for copy of FIR. please tell me which police station. I may be able to take out details for you. you should move anticipatory bail. please feel free to contact me.



Q: IS A DIVORCEE WOMEN ELIGIBLE FOR GOVT JOB IF SHE MARRIED AGAIN

MY QUESTION IS NOT FROM ANY OF ABOVE CATEGORY. ONE OF MY SCHOOL FRIEND WAS MARRIED IN 2015 AND DIVORCED IN 2017. THEN SHE APPLIED FOR GOVT JOB IN VARIOUS DEPARTMENTS. LAST YEAR SHE MARRIED TO OTHER GUY AND HAVING DIVORCE CERTIFICATE AS WELL. IS SHE NOW ELIGIBLE FOR GOVT JOB THRU DIVORCE QUOTA AS SHE IS MARRIED NOW AGAIN? KINDLY HELP

hi,no she will not be eligible for divorce quota once she has remarried again. unelss otherwise mentioned in the particular quota description. usually in general the moment she marries again she loses benefits that may be accorded to divorced womenregards shiven varma



Q: Can a video be used as an evidence in court to prove guilty.

We had a meeting including members from both side and we have audio and video recording of this meeting. Can we use those recordings as an evidence to prove opposite side as guilty. Will court consider the same. Case is from Delhi..

yes you can definitely use the audio and video recordings . however there are some legal and procedural requirements to be done before being able to use them. but to answer your question simply. yes it can be considered.



Q: Cheque Bounce NI Act vs 420 which is wise option.

Accused cheated me of 50 lakh, 41.5 lk online and 8.5 cash. he took friendly loan through friendly loan agreement and issued a cheque which got bounced due to insufficient fund.I got to know he cheated various others through ponzi scheme as well to the tune of multiple cr's but mostly have paid cash to him and reluctant to go to police.will my case be considered for 420 as well, as police mentioned it to be civil dispute, but i think its 420,406 when other complaints of ponzi scheme's gets clubbed with mine.Is it worthy to go with 420 along with NI act? if accused may abscond then it would be hard to find him in both the case of 420 or NI act. i doubt he has any asset. Imprisonment is confirmed in both case and should I avoid two simultaneous litigation ?

you should definitely go for both FIR for cheating etc and a cheque bounce case. making out a cheating case will depend on the facts and information available with us. it's is difficult to convince police to register FIR . but definitely one should make a complaint for cheating. if they don't register FIR then we can proceed to court to order registration of FIR is there is merit in the case. for detailed further information please feel free to contact.Regards,shiven varma
