CHEQUE BOUNCE NEGOTIABLE INSTRUMENT ACT 138

I have filed a case for cheque bounce but the main culprit is missing from starting day & his family is here & they say we dnt no abt him.His family sent Lawyer & they take dates after dates in court.Kindly advice me what to do need advice in this

you need to issue a proclamation again the said accused. thereafter, the case will proceed in his absence. you can further attach his property etc to recover your cheque amount or the amount awarded to you by the court.

This is my response to you: 1. You can request the court to issue a warrant against him; 2. You will have to show urgency in the matter; 3. You must take steps urgently; 4. Consult a local lawyer and take steps.

Dear Client, it is your Advocates duty to get the Warrant from the court. Cheque bounce cases are some time, time consuming, but with proper followup, results are seen. You can aslo file civil recovery suit and Cheating complaint against accused.

if the service of the summons is not yet completed by Speed Post then file an application for service of summons by email from the court and serve the summons through email and get the matter as ex parte and file your evidence to prove your case.

main culprit received the summons or not. if received summons issue nbw. if summons not received confirm exact address and re issue summons and also confirm is mobile number and email id for taking further steps
