in case of cheque two cases cannot be Run simultaneously if you have 138 n i act case under consideration in court then you cannot get FIR registered in the police station there is a special provision under section 138 n i act which you cannot registered an FIR thanku

you can register an FIR under sec 406 407 and 420 of Indian penal code. for criminal breach of trust, misappropriation of money and fraud along with section 138 of NI act. this complaint can be filled direct in court also under 156(3) or as a complaint case.
