Cheque bounce case under 138 act

I am giving payment online to payor by my friend and student google pay phone pay account and payor give me cheque my name and cheque bounce can I file case under 138 ni act is possible

if you have paid amount through gpay, then you can use the cheque and file case against him under section 138 of NI act. money gone through account is clear debt against you and hence you can file criminal complaint.

Yes, you can certainly file a Cheque Bouncing Case under Sec 138 of the NI Act. You can parallely file a Police Complaint and get that Complaint lodged into a First Information Report against such person who cheated you by getting his cheque bounced intentionally.

Yes, you can file a case against them. But a civil suit would be more feasible as in 138 matter the complexities would be difficult to prove. (via payment). A summary civil suit would be more beneficial. Summary suit would be more quicker as well.
