Case filed u/s 138 Party absconding filed wrong address in ROC

Who is responsible for tracing out address of absconding party subsequent to filing of case u/s 138 ? fake address in ROC, House sold out given Sale tax .

As the case has been filed ant the summons have not been delivered to the accused , it is suggeted to take the further orders from the court for re sending the summons, followed by notice in the newspaper by the magistrate concerned. If the person does not come even after the notice in the news papaer the magistrate can pass ex parte order.

Sir,
If you have send cheque bounce notice to opposite party and notice have served properly. U can file under section 138N.I., 420 IPC case than Court and police will be responsible arrested to accused. Police can arrested to accused by bailable warrant or non bailable warrant etc..

I would like give to you an additional advice. U may search accused address in opposite party banks.

confusing question 138 of what act - if it is N.I. Act then bring the entire case before your counsel and if you r aware with the right address you yourself can inform to the court and serve the notice and thereafter other provisions to bring the wrong does in the ambit of justice
