Can Party Files A Case For Stopping A Cheque In My Case.

18-Aug-2023 (In Cheque Bounce Law)
I issued a cheque to party. But that party did fraud with me so, i stopped cheque via phone call to bank. At time of stopping cheque i had sufficient balance. After 1 week that party presented the cheque. On same day i withdrawn money from account and makes balance less than cheque amount. Now, that party gave me notice of bounce and demanding money. However that party is full fraud. So, what should i do?? Plz give me advice. Thanks in advance.

Hi, As per the information provided by you. I would recommend that you first give the reply to the said notice at the earliest stating your points as to why the cheque was not honoured. This way you will be have a bonafide case before the court.

Hello I have perused your query. In these circumstances it is important to know the date of the said cheque or when the amount specified in the cheque became due. Secondly, some information regarding the fraud mentioned above is also required in order to advise suitable course of legal action. In case a notice has been send to you regarding the same you can reply to the same via legal notice and initate proceedings of cheating simultaneously under IPC. However, a brief description of events will give more clarity. in case of any further query feel free to reach out to us.
