Can director's name substitute by company's name in cheque bounce case

138 case cheque issued by company but case was done on individual director .can company name added afterwards please guide

No. once the complaint is filed before the Magistrate Court thereafter no accused can be added to the said complaint.
Moreover, as the judgment of Anita Hada by the Supreme Court, if the complaint is not joined as accused and the case is lodged only against director then the complaint is required to be quashed by the high Court under section 482 of Cr.P.C

The name of Director can be added in the case as per law. All the directors and the signatories can be sued in the court of law as they are the persons responsible for day today affairs of that company.

Dear ans is yes because company is legal person as per law but after all all the responsibility is of director so may be company name add and add also director name .because after all head of dep is MD so

The case will be done like first name of the company through it's directors will be done
Name of the company is to be mentioned here director solely name should be mentioned
If it is a personal transaction than name of the director if through company than name of the company is to be mentioned

Yes it can be added as cheque would have been issued in company's name bearing signature of authorized signatory so both can be sued for cheque bounce case. If you are on complainant side then surely add company's name
