Can a company file a case of cheque bounce for the payment due

If a party X whom bill is being issued,provides the cheque from company Y as a full consideration for the payment due from Y,and the cheques bounces,what is the legal recourse available to me against the party and does section 138 of negotiable instruments act applicable?

Company appointed any person on our behalf and issue letter of authorization then case will filed in court. Its like a tpye of power attorney Holder.

Yes, any representative of the company can present libel. Section 138 n.i. under act
First of send a notice to opposite party for 15 days.After that the libel can be presented in the court. After this, the court will send summons to the accused after the cognizence.

Yes this case is eligible for NI Act. A proper documentation must required to explain the transactions like order form, dispatch entries, receiving of goods or services and acceptance of giving cheque against the transaction, a proper bank note for cheque bounce due to insufficient of fund etc.
