Q: Me and my husband seprated from last month.I am living in my father's house. I have a 11 months old
Me and my husband seprated from last month.I am living in my father's house. I have a 11 months old baby. Can I claim for child maintanance without divorcre?
Advocate Hemant Kumar Joshi answered
Hi, offcourse you can claim for your child maintenance. Divorce is just a decree to live independent with having marrital right. here I also want to say you can also claim for your maintenance. so there is no relation between alimony from your husband and divorce. your husband have to pay such amount to you for your and your child's maintenance.
