Buyer not paying the amount and cheque given by him bounced what to do

I HAVE SENT MATERIAL TO PUNE IN THE COMPANY NAME BY TAKING A CHEUQE OF HIS PERSONAL NAME 3 MONTHS AGO. AS PER HIS COMMITTMENT HE HAS TO PAY MY AMOUNT WITH IN 10 DAYS .BUT HE REFUSED TO PICK MY PHONE SO MANY TIME SO THAT I HAVE PRESENTED THE CHEQUE BUT I WAS BOUNCED. NOW HE IS NOT PICKING MY PHONE WHAT I HAVE TO DO. KINDLY DO THE FAVOUR

You need to file a Chequq Bounce Complaint in the Court. Before that serve him legal notice and thereafter accordingly take action within 30 days by filing the Complaint. The notice is called as demand notice and must be filed with in 30 days of Cheque bounce.

You can file two type of cases;
1. You can file case u/s 138 of the Negotiable Instrument Act for dishonour of cheque.
2. If the Purchaser is a private or public limited company, you can file case in Company Law Tribunal provided you have enough proof of material sent to that company like Invoice, Transport receipt/ builty etc, receipt of material proof.

You can claim a relief by filing a case u/s 138 Nia Act that's negotiable instrument. Legal notice be served to accused within 30 days from the date of dishonour of cheque if within 15 days of sending legal notice accused does not pay you can go for 138 nia
