Bank informed 1 month post cheque bounce what to do about limitation

after cheque bonce bank give information to the complainent after one month, can it include in case limitation

Deposit again then it's comes within limitation there is nk need to worry about limitation. Onec it's bounce again then comes to limitation and file a case for recovery. This is only solution for your case

Limitation period of cheque is 3 month from the date of issue in between if a cheque is bounced you can send a legal notice within a month and if there is still days remaining within 3 months then it is not an issue that bank inform the complainant after 1 month

The cheque has a validity of 3 months. If the cheque bounces, then the complainant has to give notice to the accused within 1 month frm date of receiving the information regarding the cheque bouncing from bank. 15 days period is given in the notice and if no reply/no payment is made, then complaint is to be filed within 1 month after the expiry of the 15 days notice period. I have read ur query about information obtain from bank regarding bouncing of cheque after one month from the date of bounc8ng the cheque from bank .in this case you can file the case aga8nst the person but with certain proof. Then only.

As per provision under section 138 of Negotiable Instrument Act, you need to send a Legal Notice to the drawer of the cheque within 30 Days from the date of receipt of information from the bank about the dishonour of the cheque. In your case the limitation period will start from the date you received the information from the bank about dishonour.
