Anticpatory Bail in 376 IPC promise to Marry .........................

09-Jun-2023 (In Anticipatory Bail Law)
Dear All, I have applied for anticipatory bail against an FIR under 376 IPC on the promise to marry. I have whatsapp proof that I never promised for marriage, but the girl has claimed that I verbally gave my promise to her which I cannot prove except telling the truth that I didn't. Also, I have satisfying proof on whatsapp that no promise was ever made but those proofs are dated before the dates I alleged to made the promise to girl. Also, I have proof that the girl has threatened to do an FIR to blackmail me into marry her. she has also mentioned that I have demeaned her caste as she happens to belong to ST caste which I wasn't aware of until my lawyer told me few days ago. But again, I have no proof of the same. she knows some good lawyers who are helping her for this and she has prepared a very smart FIR where it is very difficult to provide anything exactly opposite of the same. I can only prove my intentions with some other documentary evidences and personal witnesses.

Query perused. You have mentioned that you have applied for an anticipatory bail, what is the outcome of the bail. There are lot of judgments where in it was held that consensual sex does not amounts to rape. For further consultancy and legal services you may contact us.

Hello ,

you need to send the copy of FIR ,
there are good chances of anticipatory bail ,
see the statement given by the prosecutrix in under 164 You have to find out the contradiction in both .
The bail might be conditional but you can get it ,there are number of cases in which anticipatory bail Have been granted to the accused in case the charges are of rape on pretext of marriage .

thanks
