Q: Alimony & child custody after mutual divorce
My marriage was held on 2017. I am a small businessman. My monthly income is Rs. 5000/Month. I have a child of 6 years old. My wife wants a mutual divorce from me instead of a big amount of money (Rs. 15 Lac). My question is can she further demand any more money afterwards? Can I ask for interim custody of my child?
Advocate Subhashis Paul answered
If you and your wife have decided to go for a mutual divorce then you both should decide who shall have the permanent custody of the child.. it should be mentioned in the mutual divorce petition also so that neither of the parties can claim for custody of the child in future as per your discussion with your wife.
