you can file at both the jurisdiction ..or can also file the same at high court at calcutta by increasing the pecuniary value..its up to you...but the question is do you want to...its a luxury suit...if filed in high court atleast the other side will get scared

Q: Buying a property without partition from one of the co owner
There are 5 landlords of a building who are brothers in relationnBut the house is not a dwelling housenI am willing to buy a flat in the building from one of the co owner.But there is no partition deed registered between the landlordnCan he sell the flat without the consent of the other co owners?

Technically you can buy his undivided share in the house, that too your seller has to offer his undivided share to all his 4 brother at market rate, if they don’t except you can buy the undivided share… this is law… and in his possession if there is a flat which you intend to buy that’s your bonus
Q: Ancestral property dispute among 4 members
It is my ancestral property. We are 3 brothers and 1sister. My parents are no more. We are willing to partition the property but one of my brother is not willing to do it. And he is constantly delaying the matter for no reason. What can we three do now? What is its legal solution?

You need to hire a lawyer together, I.e ( all three of you should be represented by a single lawyer/ law firm ). He/they will ask your brother to meet them and they will make him understand the consequences of not mutually agreeing to partition, which are horrendous compare to mutually agreeing to partition, as well as very time consuming too… even after that if he doesn’t agree, than I guess his I.Q must be very low… having no more option you have to fight it out… I.e. file partition suit and get a court decree… which is time consuming in the other hand there is settlement deed which will be quick…
Q: I the seller want to cancel a deal, so have a question about it.
So the buyer has just paid me a token money and no legal documentation has been done yet we have just had a verbal conversation and I have changed my mind now and decided to not sell the flat. So how much money should I refund the buyer? The token money only or with interest or what? Pls advise. Thanks a lot!
