Q: Threatening me to give him money if not he will take action against me
He is a escort agent whom I contacted on WhatsApp by website but when i told him that I don't want service he started threatening me and demanding money if don't give him money he takes action against me by the help of police by complant sexual harrasment
Advocate Ranjana Yadav answered
It sounds like you’ve encountered a serious and distressing scam. The person you contacted via WhatsApp, claiming to be an escort agent, is now using threats and intimidation tactics to try to extort money from you. This kind of behavior is illegal and falls under the category of online harassment, blackmail, or even cyberstalking, depending on your jurisdiction. These scammers often rely on fear, hoping that their victims will panic and send money to avoid trouble, even though the threats are typically empty. If you haven’t committed any actual crime and only contacted someone through a website, there is no legal ground for them to file a complaint of sexual harassment against you, especially if no illegal content or interaction occurred. It’s important that you do not send any money or continue engaging with this person. Instead, preserve all messages, screenshots, phone numbers, and any other evidence of the threats and demands. These can be used if you decide to report the incident to local authorities or through official cybercrime reporting portals. You should also consider blocking the person on WhatsApp to stop further communication. Do not let fear drive your decisions—this is a manipulation tactic that scammers often use.
Q: Paid full amount but product wasn't delivered and was delayed
I paid an amount to a firm for making the product which was promised to be delivered in 7 days, the seller bought the raw material from that amount but didn't deliver it for 2 months . When i kept asking for the product he gave different excuses. The thing is the product i requested was seasonal and i have no use for it now. When i requested for refund he said he will now deliver the product in some time. Or i can take the raw material. I paid for the product and not raw material
Advocate Ranjana Yadav answered
Sir,The seller has committed a breach of contract by failing to deliver the product within the agreed period of 7 days. Despite repeated follow-ups, there has been a delay of over 2 months, rendering the product commercially useless due to its seasonal nature. Offering raw material instead of the finished product amounts to unilateral alteration of contract terms, which is legally unacceptable. As you have paid for a finished product, not raw material, you are entitled to a full refund under contract law and consumer protection principles. The seller’s conduct also amounts to deficiency in service and unfair trade practice under the Consumer Protection Act, 2019.You may issue a legal notice demanding refund within 7 days, failing which you may initiate: Civil suit for recovery of amount with interest, and/or Consumer complaint for refund, compensation, and litigation costs.Let me know if need help in Drafting Legal Notice.RegardsAdv Ranjana Yadav
Q: Wife filed wrong case on my son
Please reply, mere ladke ki wife ne use bahut tang kar rakha hai, roz roz dhamki deti hai ki jhoothe case me fansa dungi, mai ghar ka koi kaam nahi karungi aur mujhe alag rahna hai, mera beta alag rahne se mana karta hai to uspar jhoothe case lagane ki dhamki deti hai, kya karoo?
Advocate Ranjana Yadav answered
Sir/Madam,Main aapki baat samajh sakti hoon. Aapke bete ke saath jo ho raha hai, wo kanoon ki drishti mein mansik utpeedan (mental cruelty) ke tahat aata hai. Patni ka baar-baar jhoothe case ki dhamki dena, ghar ke kaam se inkaar karna, aur alag rehne ke liye dabav banana – yeh sab vyavhaar uchit nahi hai.Aise mein sabse zaroori hai ki har baat ka koi na koi saboot sambhal kar rakha jaye – jaise audio recording ya likhit sandesh. Zarurat pade to police mein ek complaint bhi di ja sakti hai, taaki baad mein kanooni roop se khud ko bachaya ja sake.Agar kabhi bhi jhootha case file kiya jaye, to turant anticipatory bail lena chahiye. Aur agar sthiti aur bigadti hai, to judicial separation ya divorce bhi ek sambhav vikalp hai.Yeh sab baatein maine iss liye kahi hain, taaki samay rehte sahi kadam uthaye ja sakein. Aap nischint rahiye, kanoon sach ke saath hota hai.RegardsAdvocate Ranjana Yadav

And later said he would never visit or come back home.Mother has suffered through all fault of my father, who has continuously been talking bad about her to everyone they knew mutually from before, he had an affair, when confronted he ran away to live with some women, don’t know where he lives, he did not show up when in family court divorce was filed, mother wants to divorce him what to do now?
Advocate Ranjana Yadav answered
Madam,I understand the pain and hardship you’ve faced due to your husband’s abandonment and defamatory conduct. Legally, you have strong grounds to proceed with divorce under desertion and mental cruelty as per Section 13(1)(ia) and (ib) of the Hindu Marriage Act.If he has not responded to court summons or appeared despite due notice, you can move an application for ex parte proceedings. The court, after verifying the facts and evidence, can pass an ex parte divorce decree in your favor. You may also be entitled to claim maintenance or alimony, depending on your circumstances.RegardsAdv Ranjana Yadav
