उ.प्र. राजस्व संहिता 2006 की धारा 76(1) में असंक्रमणीय (श्रेणी-2) से संक्रमणीय (श्रेणी-1) का एकपक्षीय आदेश हुआ है। उक्त भूमि पर अन्य व्यक्ति का नाम श्रेणी-9 में दर्ज है और वह वास्तविक काबिज है। क्या श्रेणी-9 का कब्जेदार इस एकपक्षीय आदेश के विरुद्ध रेस्टोरेशन/आपत्ति दाखिल कर सकता है? क्या रेस्टोरेशन प्रार्थना पत्र पर जांच/आख्या हेतु पत्रावली लेखपाल को भेजी जाती है? इस प्रकार के मामले में रेस्टोरेशन और स्थगन (Stay) की सही विधिक प्रक्रिया क्या है?

महोदय मेरे दादाजी ने अपनी मुसीबत मेरी मम्मी और मेरे भाई के नाम कर दिए हैं लेकिन अब ऐसा सुनने में आ रहा है कि मेरे पिताजी ने संपत्ति की रजिस्ट्री अपने नाम करवा ली है हालांकि अभी हमें इसकी पुष्टि नहीं हुई है और नहीं हमें पता चला है लेकिन जो मेरे भाई हैं उनका ऐसा कहना है कि उन्होंने रजिस्ट्री करवा लिए और वह वहां पहले वह मुंबई रहते थे और उन्होंने एक दूसरी शादी की थी लेकिन अब उनकी जो दूसरी पत्नी है उनका देहांत हो गया और वह किसी दूसरे कास्ट की थी यह पंडित है और वह ठाकुर थी लेकिन अब उन्होंने वहां पर मुंबई में घर भी बनवाया हुआ है अब उनकी मृत्यु हो जाने के बाद मेरे दादाजी की मृत्यु में में हुआ है उसके बाद वह यहीं पर आकर रहने लगे मेरी दादी जी के साथ और यहां पर आकर वह किसी करने को खेती करने लगे हैं और अब हमारा और उनका कुछ भी लेना-देना नहीं है उसे हमारे परिवार से जो मेरे दादाजी की फैमिली थी उन्होंने आज तक हमें कभी भी कुछ भी नहीं दिया है तो इसीलिए मेरी मम्मी ने उनके ऊपर उनके ऊपर मुकदमा दर्ज कराया था अगर उन्होंने अपने नाम करवा भी लिया होगा क्या यह मुमकिन है कि वह अपने नाम करवा सकते हैं क्या करें
