See, there are few steps that you’ll have to follow-1. You have to present the cheque to the bank within a period of 6 months from the date when it is drawn or within the period of its validity;2. Once the cheque is returned unpaid, you’ll have to serve a notice to the other party within 30 days;3. If the other party doesn’t make payment, even after receiving the said notice, he can be prosecuted u/s 138 of the Negotiable Instruments Act.
