Questions Answered by Advocate Prabhash Chand
Q: Low quantity in seal packed Can.
I bought a "CAMPA COLA CAN" it was sealed can and mentioned quantity was 185ml on can, but when I weight the can their actual weight was 85gm, I kept the can without opening, can I file legal complaint against the company ?? And can I get compensation if company founds guilty ????
Advocate Prabhash Chand answered
Yes, you have a valid ground to initiate proceedings under the Consumer Protection Act, 2019. If a sealed can clearly mentions a quantity of 185 ml but, upon reasonable verification, the actual content appears significantly less, it may amount to deficiency in service as well as an unfair trade practice. However, one important issue in your case is that weighing a sealed can (85 gm) does not directly establish the quantity of liquid inside, because the total weight includes the aluminium can itself. Therefore, to strengthen your case, it is advisable to get the product tested through an authorized laboratory or open it in the presence of independent witnesses and properly measure the contents. You should preserve the bill, packaging, and the can in its current condition. A legal notice to the manufacturer and seller should be the first step. If no satisfactory response is received, you can file a complaint before the District Consumer Disputes Redressal Commission seeking refund, compensation, and litigation costs. If the company is found guilty, compensation can definitely be awarded, especially if misleading labeling or deficiency is proved. For advice , kindly contact the undersigned
