Q: Can we Change our Lawyer in civil suit?

Hi,My lawyer is otherwise competent but he got serious anger issues. People warned me about the same before taking him as my lawyer. But since he is my old friend I ignored people's warning. I hired him thinking these issues won't be between us. His behaviour as a lawyer is disturbing me a lot, I told him about the same but things are not improving so, I am thinking of changing my lawyer. Is it possible? It's a civil suit.How easy is it? Will it affect my case?Please advise. Thank you

It is always prerogative of client to have advocate of his choice. You can change it whenever you want advocates rely on paper so it will not hamper your case if he has any confidential information regarding case. As a friend, he must share with you.

Q: Regarding becoming petitioner in COCP

There is case regarding pay commission in Punjab. Some of the employees filed CWP in high court and court gives in favour of those employees. But due to some reasons I am not able to become petitioner in this case. Now those employees filed COCP in high court, I also want to become petitioner in this case what will I do because the benefits are provided to those who filed case in high court

Firstly, you need to check the judgement. Is it only for the petitioners or for all employees working in the same cadre? Then further course of action can be decided. It can also be discussed through online consultation.

This is a very common practice in the courts to write the name with alias. Likewise, it means the person in your case has his name as Jitender. But he is known as Johny amang his friends and relatives. Therefore, to clarify the Jatinder and Johny are the same person they have write this word @ in the particulars of application. It cannot be termed something serious error in the petition.

Q: FILE PETITION IN HIGH COURT FOR WORKING ABROAD

I have asked permission from session court regarding going abroad for work. But twice my application was rejected. However, i wish to file high court, pls let me know the documents necessary and how things will proceed and how much time it will take

To apply at the High Court. You need to submit a copy of your passport, application with travel documents, and where you want to visit abroad. The court may also seek a bond as a surity that you will return back from foreign country.

Q: Dispute is between my family and my father's sister family.

My grandfather died on 3rd dec 23, and father died on 2011, my grandfarher had 3 children 2sisters and 1 son(yongest), i am his grandchild, he left a property and he left documents of all his heritance in his cupboard. When i came from vizag to jalandhar address to do cremation to my grandfather my buva took all the documents and left. Now they are not showing if my grandfather made any will or his my post office books. Now what to do ???

In such cases it’s difficult to find whether your grandfather has executed any will in favour of you or not. The only way out left with is you can go Tehsil where in the property situated and check by giving particulars of your grandfather. Is there any document executed by your grandfather if you found that there is any will then you can file civil Case for transfer of property on the basis of that will
