Q: Divorce petition and child support

I am a working woman earning 50 k monthly have 2 kids 3 year daughter and 9 month son from 10 year marriage. The father education wise engineer is currently willingly unemployed . Reason for filing for divorce is father is extremely irresponsible towards kids , does not pay any money towards their expenses and constantly threatens me to leave his house if I refuse to be intimate . He abuses me and my mother verbally everyday. What are my legal rights? And also what is the money I can expect for

as you are leaving separately from your husband and kids are living with you, you have the right to ask for maintenance of kids and for yourself as well, we are not sure that court will provide you a maintenance as you are working women earing 50 thousand per month which enough for a middle class person to survive but you have all right to ask a maintenance for your children as it is a responsibility of the father as well. Apart from this if we talk about abuse from your husband you can also file a complaint for domestic violence, in this you can get compensation for the abuse and get an amount for house rent as well. Further you can file a police complaint under bns for abuse(old 498)

sometimes divorce proceedings move at a slow pace, it depends on the court in which your case is pending, looking at your query your case is pending on your evidence from last dates, in this scenario you have to approach your advocate and inquire that why they are not submitting your evidence and you have to ask them that what information they lack for creating your affidavit and what document they need to submit as your evidence in your court. once you submit your evidence in a case the case will proceed further for your cross examination.

First of all contact your bank and inquire which cyber cell has given an order to the bank to freeze your bank accounts and other details they have received from cyber cell, they are obligated to provide you with Cyber Cell names such as Ahemdabad or Vadodara, etc., Acknowledgement No., any other details available with them.. After receiving this details you can contact any advocate and you can file an application at the respective court which has a jurisdiction over whatever cyber cell has frozen your account and can get it un-freezed.

I am illegally confined by my parental family, forcibly separated from my husband despite a Gujarat High Court protection order (26/09/2025). I face death threats to me and my husband, sexual assault threats by my uncle, abetment to suicide threats, forced divorce, forced second marriage (BNS 87), and was made to sign blank papers under coercion.
