Q: What should I do if I am unable to pay the maintenance? What if the husband is unable to pay mainten

I am jobless, and before the judgment to pay maintenance to my wife of Rs. 11,000/- per month, I was unable to pay it. To date, I have not received any job of that kind. I only received a temporary job of 3-4 months, paying me around Rs. 6,000/- per month. My wife has filed a petition for not receiving maintenance. I was not present at the court hearing, and the court has issued an NBW against me. I changed my residence, and many warrants were sent to my parents, which they returned. Now, the family court has ordered a punishment of around 4 years. What should I do if the husband is unable to pay maintenance?

You can settle the case with your wife you can take divorce and paid her lumsum maintenance. Try to settle the case with your wife. you dont have any other option. You can also file case under section 127 of cr.p.c. for revising amount of maintenance as you are jobless.

We have a family dispute on 28 january 2024.my wife went on rampage and attacked my father (74) yrs of age. My father filed a police complained against her. Since then she is living away with me. you can file a complaint against your wife . you can file child custody case . you can send your wife legal notice for of restitution of conjugal rights . you have to collect evidences against your wife that she deserted you without any reasonable ground . you should also evidences that your wife is deprived from the love and affection of your children children

you can leave the home and send your father legal notice through Advocate and you can file complaint at Women commission, Mahila police station . They will help you . you are adult and you have right to take decision of your life. your father is depriving you from education and beating you is not permissible by law

You need evidence of all wrongs committed by her. first of all collect all proofs like video recording , eye witnesses or anything else which can prove her acts/ wrongs. you may also take help of police. if she didn't stop send her legal notice through an Advocate.
