Q: Maintenance related contested divorce in process

What is maintenance and what is interim maintenance ? Are both different? Do we need 2 file different cases ?

Interim Maintenance is demanding the maintenance during the pendency of your suit (pendente lite). You must have filed a Domestic Violence case demanding interim maintenance arising out of the DV Act. You can file for maintenance under Section 125 CRPC (which is asking for final maintenance). Yes, it is a different case.



Q: Wife and father in law threating for money

After court marriage, me and my wife went to my home and stayed there for one and half months. We lived peacefully there. When she went to her home, her parents forced her to file 498 and 125. She told me this that you will receive summon from court and protect yourself. Before that, her father asked me to make a fixed deposit of 20 lakhs in her name and registry of one third house in her name if I want to live with her. After that, wife switched off her phone and father in law stopped talking to me or any of my family member. Suddenly, two days before, police came to my flat with my wife and FIL and took us ( me and two of my friends who are witness in the court Marriage) saying that we kidnapped the girl and misbehaved for a period of 40 days. Although the girl used to talk daily with her family over phone, police said that the father has filed missing complaint 40 days ago, although no fir was filed. In police station, the FIL again asked for 20 lakhs and registry of house.

Please do not make any fixed deposit in her name without consultation with your lawyer. I hope the girl was not a minor when you married her? If the marriage took place legally and was registered at the registrar of marriages, there is no weight in the statement of the parents. Please explain whether the police has registered a case against you or the witnesses? There are many things to be known before a comprehensive legal opinion can be given.



Q: Domestic violence case- while contested divorce in process

I received summons for contested divorce from husband however I want to contest it and doesn't want to give divorce . Meanwhile can I file for domestic violence and maintenance against husband ? Also can I file 498a?If want to file dv ,MC but doesn't want to give divorce ? Will that b possible

You can file a 498A, DV Act Case, Maintenance included in your DV case and demand your Streedhan by filing a case u/s 406 IPC if not given to you by your husband amicably. If you do not want divorce, you can contest the case. However, if you follow up with so much litigation, it is better to go for divorce at a decent alimony and/or maintenance amount.

If the judgement has been passed, you can ask your lawyer to get you a certified copy of the said judgement/decree (submit a nakal sawal application). Technically those are different things, but if the divorce decree has been passed, that's enough proof.

If wife is professionaly qualified more then husband and even working and earning the same as husband is husband still liable to pay her anything

Yes. She can still apply for maintenance under Section 125 CRPC. However the amount of maintenance can be challenged in court to be either completely denied or significantly lessened. In such cases both your wife and you will have to attach your income proof on affidavit for court to decide.
