Q: How to get child custody of my 2 year old son from my wife
I'm Australian citizen married to Indian citizen with 2 year old son. I want to take my son to Australia but my wife doesn't want to. We got married in India and are settled in India. My son got Australian citizenship by descent. Can I take my son along with me to Australia. My wife is not applying for Australian spouse visa.kindly advice.

Firstly you can apply for your child's custody in Australia since you both are Australian citizens.In India usually the custody of the minor child up till the age of 5 stays with the mother unless you can prove that she is a misfit to take care of your child on the grounds of neglect and ill treatment.
Q: Wife asking for separation after 6 months of marriage
Both me and wife are Hindu. Got married 6 months back. Staying with wife in Noida now. Wife is insisting for separation on the grounds that I am not financially supporting her adequately; as she wants me to hand over a better part of my salary to her. She will not be able to file a divorce case till the marriage is 1 year old.You can submit an general intimation letter to the area police SHO, stating that your wife is planing to move out on the grounds financial discontent. Therefore you suspect that she can file false complaints against you.

Hello, I am 30 years old and have 2 year old daughter. My wife left for her maternal home with my daughter last year after some small argument with my mother. She said she will be back in 15 - 20 days. But after around 1 month she came with her parents and some relatives to my house to discuss the issue. In that discussion it was concluded by her relatives that her parents attitude was not correct. They all left the home without our daughter. My daughter was 1 year old. Later me and my parents tried to resolve the issue. But she nd her parents said that she will come back only if I get seperated from my parents.From the past 1 year my daughter is with me. In between she sent some letters to my office and seniors levelling false allegations against me nd family. We are living seperately for 1 yr. You can definitely file a divorce and you can file that she has deserted you.If you want your wife back for the sake of your daughter then you can also file RCR. I will request you to keep your daughter as priority and sort out things at your end as soon as possible.

Married in 2012, facing dowry demands and severe thrashings of husband and many a times by his sister and brother in law and mother. The mother in law, sister in law, brother in law and Mama instigate him to do all this. They have taken a lot of money also. A miscarriage happened by the beating of sister in law. I have a kid of 2 years, now it became unbearable so I filed an FIR, they r influencing people, police not taking any action. He ran away from home after beating me and filed a divorce, I am left alone with the kid. Neither he talks nor supports the home. Hi there,What is the proof of taking lot of money?When miscarriage happened did u file a complaint and went to see a gynaecologists to consult further?For maintaining the household expense you can simply file a Maintainence Petition U/S 125 of Cr.pc. At the first instance the court will allow you to claim interim maintanance from your husband. If he has complained that you are insane for that he needs to prove it also.Nothing is proved without any evidence.

Police cannot harass the couple and if it so then, the lady can call on the women help line number and lodge a complaint against the police man for harassment.And in some cases police definitely can lodge an FIR if a lady along with you is married and her husband gets to know about it, he can file a complaint against you and get his wife MLC done there and then. MLC refers to the medical check up.
