Jamanat milne ke bohat acche chance hai principle of parity ke andar, aapko bilkul bail ke liye prayas karna hai, lekin uske phele ye dekhna zarori hai ki zisko bail mil chuki hai uske virudh kya ilzam lage the aur kya saksh aur gawahiya aai hai, itna sab dekhne ke Baad kuch pukhta tarike se aapko bata sakte hai
Q: FIR QUASHING of criminal offences. Fir filled with false allegations.
CBI Submitted charge sheet on 28.03.2025 at the sessions court, Bhopal. Till now chargesheet not served by the court due non observance of cognizance. Is it better to wait sometime or to go Jabalpur High Court to quash FIR.
advocate Abhay Kesharwani answered
You have the right to approach the High Court directly for quashing the FIR at any stage before or after charge sheet, before or after cognizance under Section 482 CrPC. However, the grounds for quashing must be strong, such as the FIR being baseless, abuse of process, civil dispute given criminal color, or a clear lack of evidence. The stage of the proceedings is not a legal bar to seeking quashing. In fact, it may be advisable to approach sooner rather than later if you have valid grounds, as prolonged delay itself rarely results in quashing.

Q: Degree equivalence issue affecting future and eligibility
If a student is pursuing a course titled "Mining and Mineral Processing" under a recognized public university, but later learns that the degree is not considered equivalent to "Mining Engineering"—which is required for government certifications—can the university be legally compelled to issue an equivalence certificate, especially after repeated RTIs, complaints to authorities, and submission of comparative syllabus showing over 93% similarity?
advocate Abhay Kesharwani answered
If you believes your course merits equivalence, you must petition the relevant statutory authority (such as the Directorate General of Mines Safety, or UGC/AIU) and provide documentary proof such as syllabus comparison. I can also do that for you. However, a high degree of syllabus overlap is not automatically binding; national regulators may consider other factors like title, accreditation, program outcomes, and statutory notifications. You can so send a representation. If the regulatory authority or statutory council refuses equivalence without reasonable cause, you can seek judicial redress. Court can intervene if discrimination or malafide intent is proven.
