Transfer of ownership of agricultural land

Sir, We three brothers jointly own 4 acres of land (self acquired) in Karnataka. Being senior citizens and not able to manage ourselves, we would like to transfer the ownership to our three major sons. My query is: a) Being from an agricultural family, can we transfer through Gift deed and get the Khatas obtained from Tahsildar? b) While transferring ownership,can we trifurcate the land into three parts for each son in the Gift deed? c) Can the Tahsildar object to issue Khata on the ground that sons are not agriculturists and their income is above the ceiling limit? Thanks.

Firstly answering your query No: 1 I would like to suggest that YES an agricultural Property in your situation can be transferred through Gift Deed and you all can also trifurcate the land into three parts for each son with the consent of all you land owners. However it is important to note that when you transfer an agricultural property you should transfer the same to the agriculturists who are holding RTC in their name and thus the thasildhar can object to issue katha on the ground that their income is above the ceiling limit and that they are not agriculturists. For further and right advise it is essential to check the Documents as to the nature of the lands and advise on the same
