Maternal grandfather's property not being given to mother and her sis.

My maternal grandfather has some self acquired. He died a 5 years back. There are 2 different wills at this time. My mama's are not wiling to give share to my mother and mausi. What action can we take?

you have to file immediately for partition of the propertyand probate of the will. Once you file the case you will most likely get a stay of the property and your mama will not be able to sell it to any third party. You are a legal heir and are entitled to your grandfathers property and your mamas cannot take away your right. You can start by sending them a legal notice through an advocate.

The subsequent Will executed by your maternal grandfather is valid and can only be acted upon. However, plea of fraud, force,coercion are certain grounds in the basis of which even the subsequent Will can be challenged in court of Law.

Sir,

Your mama have to get the will probated and then only he can become the absolute owner of the property, in the meantime your mummy and massi can file the suit claiming the share in the property.
