12-Jun-2023 (In Property Law)
My grandfather( religion: jain) has written in Rs 500 stamp paper how partition should take place. The stamp paper is notarised too.At present the business and lands are of somebody's name and it has to be given to somebody.According to notarised stamp paper partition will be effective from 1st April,2017.All his heirs have right now agreed & has given signature in notarised stamp paper. Will it be binding for everybody to do partition in that way.

Notary documents are not a valid documents for partition. For partition you have to file a civil suit in a competent court having jurisdiction to try and hear the case where all the legal hrirs are necessary parties.
It is not biniding on the parties as well.
