Developer sold and registered the same plot to two buyers

I purchased a site (30'x50') in Bangalore from a developer and got the sale registered in the sub-registrars office(Kengeri) in June 2010. I had taken the help of an agent to verify the documents. However when I applied for transfer of khata recently I came to know that the same site was sold and registered to another person in May 2010(15 days before my sale deed was registered).
The developer promised me to give me an alternate site but he has started avoiding me now. How to recover this money? Can I file a cheating case against this developer. Or only a civil case can be filed for this?
Fraudulent sale by developer amounts to cheating U/s 420 of IPC you can file criminal complaint against the developer, for cheating and fraud. Also you can file civil cases against the developer for the recovery of the money towards these sites. If you are in possession of the site, you can file for permanent injunction against the earlier owner and the developer as common defendant in the said case.

You can file cheating case(criminal) and you cal also file civil case for recovery of money. Send legal notice immediately. if he fails to correct his mistakes to your satisfaction, with 15 days of legal notice, you can sue him.
