can the son apply for legal heir certificate with his mother & brother

My father was died I want to sell my property .my mother have two son and three daughter .daughter are married.can I apply for a legal heir my mother with me and my brother.

First apply for legal heir certificate. After that you may ask your brother,sisters and mother for their share if they do not have objection then you may sale the property but without their consent you can not brcause they have equal share in the property of your father. If the property is self acquired property then only your mother can sale it.

Legal Heir can be applied by any one of the surviving of the deceased. Yes you can apply for the Legal Heir Certificate. The certificate will contain all the names. Like your mother, brother and sisters.
If you want to sell the property, signature of all the legal heirs or no objection of the LH is required.

Since your mother is the next legal heir to your father, she can apply for legal heir certificate. Once the legal heir certificate is issued, you can execute a power of attorney with your mother in your favour and sell the property as desired.
