The crucial issue who had funded the purchase value? If the funds belonged to your husband, the property is wholly vested in your husband. However, this is subject to proof through evidence duly adduced if the matter reaches a civil court, that too after the life time of your father-in-law.

Only the persons whose names are in the sale deed will get ownership over the property. However if the father gift or write a will in favour of younger brother, he will get the share of the father. Similarly if father dies intestate (without making any will) his half share in the property will devolve on his legal heirs including your husband and his younger brother.

Property is in the name of the father and his son. Both are holding the property as the equal share holders. And the property is undivided one. In this case after the death of the father the property will be devolved upon his legal heirs including the younger brother as u mentioned
